Sanoyas Rides Australia Pty. Ltd., trading as The Melbourne Star Observation Wheel (hereafter: “The Melbourne Star”) ACN 165 079 390, places great importance on the safety of all its Guests and endeavours to ensure that its high standards are met by all Guests visiting The Melbourne Star.

You are admitted to The Melbourne Star subject to the Terms and Conditions set out below.

By entering The Melbourne Star, you accept that you have a duty, to take all reasonable steps to ensure your own safety, and ensure you have taken all necessary precautions for any personal medical conditions that you may have. 

If you do not comply with the Terms and Conditions you may be removed from The Melbourne Star by Melbourne Star staff, security or police officers, without any right to a refund of your ticket.  This is without prejudice to any claim that The Melbourne Star may have against you or arising out of your actions.  Whilst on the Premises, you must comply with any reasonable instructions given to you by our Melbourne Star staff.  The Melbourne Star reserves the right to vary these Terms and Conditions at any time without prior notice.

All persons who:

·       take a flight on The Melbourne Star;

·       are visiting The Melbourne Star Premises;

·       are on The Melbourne Star Piazza;

should always behave in a safe and respectful manner at all times and comply with the Terms and Conditions of The Melbourne Star.

We hope that you will have an enjoyable and memorable time.

1. GENERAL

The Melbourne Star travels at a low speed.  Passengers travel in Cabins that can accommodate up to 20 people.  The duration of a flight on The Melbourne Star is approximately 30 minutes.  There are no toilets or washroom facilities inside the Cabins.

The Melbourne Star Team is delighted that you have decided to experience this unique Melbourne icon and the largest observation wheel in the Southern Hemisphere. 

1.1  By holding a ticket for a flight on the Melbourne Star and by entering any part of the Melbourne Star Premises:

·       you are deemed to have read, understood and accepted all The Melbourne Star Terms and Conditions;

·       you have agreed to comply and be bound by The Melbourne Star Terms and Conditions.

If you are unclear or do not understand the Terms and Conditions, you should consult the Duty Manager at Guest Relations (at the ticket booth) before you take the flight.

1.2 The Melbourne Star Management reserves the right to refuse entry or remove any person from the Premises or any part of the Premises for failure to comply with any of the Terms and Conditions.

1.3 Operational Hours are subject to change without notice and may be reduced or extended due to weather, operational requirements or at the discretion of The Melbourne Star Management Team.

1.4 The Melbourne Star Management will use their best endeavours to ensure that the Premises is open to Guests during normal advertised opening hours.

        The Melbourne Star Management reserves the right to:

·       close the entire site (The Melbourne Star, The Melbourne Star Premises and The Melbourne Star Piazza);

·       close part of the site;

·       cancel a flight on The Melbourne Star at any time.

In the event of a closure of the entire Premises, or part of the Premises, or a total cancellation of all flights; The Melbourne Star will reschedule all flight bookings to another date and time. 

The Melbourne Star will not be held liable or accept any liability including, any claims of consequential loss or any type of personal claims for the reimbursement of expenses with respect to the closure of the entire Premises, or part of the Premises, or a total cancellation of all flights on The Melbourne Star.

1.5 The ticket may nominate a flight time.  This time is indicative only and, at busy times, Guests should expect delays.  Management will use all reasonable endeavours to keep waiting time to a minimum.

1.6 The duration of each flight on The Melbourne Star may vary.

1.7 Tickets are available for purchase at Guest Relations (the ticket office on the ground floor) or through The Melbourne Star website – www.melbournestar.com. 

If you purchase your ticket through this website, you will gain access to an online page containing a printable tax receipt containing an e-ticket. You must print and present an e-ticket at the check-in point on the boarding platform.

1.8 Vouchers can be purchased from selected hotel concierge desks, automobile clubs, travel agents, approved trade and re-seller agencies, accommodation and tour outlets.

The holder of a voucher will be entitled to exchange the voucher for a ticket at The Melbourne Star.

1.9 Only persons holding valid tickets are allowed to enter the boarding platform and to board a flight on The Melbourne Star.

1.10 Infants aged 4 years and under may travel free when accompanied by a paying parent or paying legal guardian. Prices for additional persons are published on the electronic price screen, or on The Melbourne Star website or you can enquire at Guest Relations (the ticket office on the ground floor).

1.11 Tickets must not be resold without the prior written consent of The Melbourne Star. 

If The Melbourne Star reasonably believes that a ticket has been resold without prior consent, the holder may be refused entry to or may be removed from The Melbourne Star and The Melbourne Star Premises. 

There will not be any right to a ticket refund or claim for compensation. 

1.12 You are responsible for all your property, the property of those persons under your care and the property of those under your supervision whilst on the Premises. 

1.13 There are restrictions on taking large bags, suitcases, heavy items and backpacks into the Cabin.

1.14 There are user pay locker facilities available for Guests to store personal property that cannot be taken on board a Melbourne Star Cabin.

Locker fees for the first 1 hour is:

·       Small           $2;

·       Medium       $4;

·       Large          $6.

          After the first 1 hour, there are additional fees for every additional 30 minutes.

1.15 Queue jumping at Guest Relations (the ticket office on the ground floor) or while waiting to board The Melbourne Star Cabin is strictly prohibited.

1.16 The Melbourne Star has trademarks, copyright and other intellectual property rights.   You must not infringe the trademarks, copyright and intellectual property rights of The Melbourne Star.

Penalties will apply for any breach of The Melbourne Star trademarks, copyright or intellectual property.

1.17 All ticket prices are subject to change without prior notification.

1.18 All financial transactions will be processed in Australian Dollars.

2.      TICKETING

2.1  General

  • The number of persons per Cabin may vary and is at the absolute discretion of The Melbourne Star Management.

                  The maximum capacity is 20 guests per Cabin.

  •        Tickets may be purchased for flights on The Melbourne Star for a shared Cabin or a Private Cabin. 
  •        Unless a Private Cabin has been booked;

– you must progress through the queue line without stopping and board the next available Cabin.  Refusing to board or waiting for your preferred Cabin is not permitted.

– groups will not always be able to travel in the same Cabin.

  •       Concession tickets are available for purchase. 

The concession card holder must:

  • provide proof of their eligibility to purchase a concession ticket;
  • provide one of the following:
    • Australian Concession Card;
    • Australian or New Zealand Seniors Card;
    • Australian or New Zealand Pensioners Card;
    • a student card.
  • There are no refunds or exchanges on any tickets.
  • Lost, damaged or stolen tickets will not be replaced.

2.2   Private Cabin

A Private Cabin can only be hired by persons aged 18 years and over.

Persons booked for a Private Cabin must arrive at The Melbourne Star Guest Relations (the ticket office on the ground floor) at least 20 minutes prior to their designated flight time.

2.3       School Group Bookings:

·       Primary age

The Melbourne Star recommends a minimum of 1 teacher or parent or nominated guardian or supervisor aged 18 years and above for every group of 10 pupils.

·       Secondary age

The Melbourne Star recommends a minimum of 1 teacher or parent or  nominated guardian or supervisor aged 18 years and above for every group of 19 pupils.

Check Guest Relations (the ticket office on the ground floor) if there are any other additional Terms and Conditions specific to education groups and groups with children. 

2.4 General Admission tickets and Sights & Lights tickets:

  • are valid for redemption for 12 months from the date of purchase.
    • once your first Sights & Lights flight is redeemed, your second flight must be taken within 30 days and prior to the ticket expiry date if less than 30 days from the redemption of your first flight. ‘
    • all Sights & Lights tickets are Non-Transferable, Non-Refundable and Not-Redeemable for cash.   
  • tickets will not be extended.
  • are not valid for any Melbourne Star Special Events. 

2.5 The Melbourne Star Annual Pass:

  • Annual Pass Holder must be a resident of Victoria, Australia;
  • Annual Pass is Non-Transferable and must include a photo of the Annual Pass Holder;
  • Annual Pass ticket purchases must be redeemed at Guest Relations (the ticket office on the ground floor);
  • Annual Pass cannot be used on New Year’s Eve, Australia Day,  Valentine’s Day, any Melbourne Star Experience Package and in conjunction with any promotional offer;
  • Gift purchases of the Annual Pass must be purchased in the name of the recipient; 
  • Replacement Annual Pass cards cost $10 each;
  • Annual Pass is Non-Refundable. 

2.6 The Melbourne Star Double Spin ticket:

  • can be purchased in The Melbourne Star Retail Shop after your first flight and is not available for purchase online;
  • cannot be purchased, scanned or the flight taken one hour prior to the close of The Melbourne Star;
  • are subject to block out periods and will not be available for sale or for a flight during special events and functions (eg: New Year’s Eve, Australia Day evening, fireworks displays) and as specified by The Melbourne Star;
  •  second flight (Double Spin) must be taken immediately after purchase.  
  • There are no refunds or exchanges for any component of the Double Spin ticket;
  • cannot be combined with any other promotional offer;
  • second flight is Non-Transferable. 

2.7 The Melbourne Star Experience Package: 

  • is valid for redemption 12 months from the date of purchase;
  • once booked, cancellation charges outlined in the third party’s commercial catering’s “General and Specific” Terms and Conditions will apply.

2.8 The Melbourne Star Special Event Package:

  • is only valid for the nominated date and departure time;
  • is subject to the third party’s commercial catering’s “General and Specific” Terms and Conditions.  Cancellation charges apply.

2.9 Gift vouchers are redeemable for up to 12 months from the date of purchase.

2.10 Third Party Provider:

The Melbourne Star may sell tickets as an agent to a Third Party Provider.

Flights, events, meals and other services to be provided as a result of the sale will be subject to the third party’s commercial catering’s Terms and Conditions.   

Cancellation charges apply.

The Melbourne Star will not be held responsible to any customer with respect to any financial loss or financial damage which arises out of, or in connection with, or as a consequence of, the provision or non-provision of any services of a Third Party Provider. 

3.    CODE OF BEHAVIOUR

3.1 You must comply with all Melbourne Star Terms and Conditions, directions, safety instructions and requirements which will apply to every person taking a flight on The Melbourne Star or visiting the Premises.  

 If you do not comply with Melbourne Star Terms and Conditions you will be removed from The Melbourne Star by Melbourne Star personnel, security or police officers.  This will not prejudice any claim or legal action that The Melbourne Star may have against you arising out of your actions.        

There will not be any right to a ticket refund or claim for compensation.

3.2 You must obey all reasonable verbal instructions and advice and warnings instructions given by Melbourne Star Management.

3.3 You must not behave in a way which disrupts the safety or enjoyment of other Guests on any part of the Premises. 

Offensive, irresponsible or unsafe behaviour, theft or vandalism, will not be tolerated and may result in you being removed from The Melbourne Star and Premises.

3.4 You must not smoke (including e-cigarettes and vapouring) anywhere on The Melbourne Star, Melbourne Star Premises and Melbourne Star Piazza.

The use of illegal substances is strictly prohibited and any person found possessing, using or who appear to be under the influence of illegal substances will be refused admission and escorted from the Melbourne Star Premises.

3.5  Any person, including guests, affected by or who appears to The Melbourne Star Management to be affected by alcohol or drugs, will not be permitted entry to The Melbourne Star, Melbourne Star Premises and Melbourne Star Piazza.

There will not be any right to a ticket refund or claim for compensation.

3.6 No food or alcoholic beverage may be taken onto or consumed in a Melbourne Star Cabin except for pre-arranged Private Cabin dining managed by The Melbourne Star and purchased at The Star Departure Lounge.

3.7 Food or alcoholic beverage purchased from The Melbourne Star café prior to your flight is allowed to be consumed in The Melbourne Star Cabin.

3.8 No eskies, wine coolers or any other container used to hold any type of alcoholic product is allowed on The Melbourne Star.

3.9 Non-alcoholic drinks are permitted only if the drinks are contained in sealable plastic bottles, cans or containers.

3.10 Pets and animals are expressly prohibited in Melbourne Star Cabins and Premises.

The Melbourne Star welcomes guests with vision impairment, Deaf/deaf or Hard of Hearing and their guide, hearing or registered assistance dogs.           

3.11 Appropriate clothing and footwear must always be worn at The Melbourne Star, Melbourne Star Building, Melbourne Star Premises and Melbourne Star Piazza.

Persons without shirts or wearing offensive clothing will not be permitted entry.

3.12 No running is permitted on or in the vicinity of The Melbourne Star or anywhere within The Melbourne Star Building or The Melbourne Star Piazza.

3.13 You are prohibited from taking onto The Melbourne Star Cabin, The Melbourne Star Premises and The Melbourne Star Piazza:

any type of weapon;

  • fireworks;
  • smoke bombs;
  • glass bottles;
  • any type of flammable liquid;
  • any other dangerous article which may cause injury or cause distress or discomfort to other Guests;
  • any item that The Melbourne Star Management deems to be dangerous.

Any person found in possession of an article deemed by The Melbourne Star Management to be offensive or dangerous will be immediately escorted out of The Melbourne Star and The Melbourne Star Premises.

The Melbourne Star Management reserves the right to report to the relevant authorities. 

There will not be any right to a ticket refund or claim for compensation.

3.14 You are admitted to The Melbourne Star and The Melbourne Premises on condition that, if requested to do so, you will allow yourself and your belongings to be searched, inspected, scanned at any time.

Failure to submit to a security check may result in The Melbourne Star cancelling your ticket and refuse you entry.

3.15   Motor vehicles, motorbikes, skateboards, scooters, bicycles, roller blades and other equipment that may interfere with pedestrian traffic are not permitted on The Melbourne Star Piazza.

4.   HEALTH AND SAFETY

The Melbourne Star Management team endeavours to always ensure a very high standard of safety and security of all Guests.  Health and Safety conditions are regularly reviewed both internally and externally by all relevant Victorian authorities.

The Melbourne Star will always put the safety and security of its Guests first.

4.1     You Should Not go on a Melbourne Star Cabin flight if you have:

  • a severe medical condition;
  • an infirmity;
  • ambulatory difficulties;
  • a fear of heights;
  • a fear of enclosed spaces. 

4.2 Guests with ambulatory difficulties or requiring wheelchairs should notify Melbourne Star Management in advance of their special ambulatory needs in case assistance is required when boarding the Cabin, during a flight inside the Cabin or when exiting the Cabin.

 The Melbourne Star Management team strongly recommends that Guests with ambulatory difficulties are accompanied and assisted by a capable adult carer, adult guardian or adult companion.

4.3 Mobile Scooters are Not Permitted inside The Melbourne Star Cabin.

4.4 There are restrictions on Strollers and Prams

  Strollers and Prams:

  • may only be allowed in the Melbourne Star Cabin with the special approval of Melbourne Star Management;
  • that can be folded and carried on board the Melbourne Star Cabin may be allowed; 
  • may be left in the user pay locker facilities on the Ground Floor (near Guest Relations – ticket booth);
  • left in the designated area adjacent to the boarding platform on Level 2 is at the owner’s risk.

4.5 There are restrictions on Motorised and Non-Motorised Wheelchairs

The Melbourne Star restricts to a maximum of 6 Motorised/Non-motorised Wheelchairs on any one full revolution of The Melbourne Star Cabin flight.

The Melbourne Star restricts to a maximum of 2 Motorised/Non-Motorised Wheelchairs per Cabin per full revolution at any one time.

·       Non-Motorised Wheelchairs

 Occupants of Non-Motorised Wheelchairs must be accompanied and assisted by a capable adult carer, adult guardian or adult companion.

 The capable adult carer, or guardian or companion must manually push the occupant of the Non-Motorised Wheelchair on board the Cabin. 

The Non-motorised Wheelchair must have the brakes applied and engaged.

·       Motorised Wheelchairs

 Must not drive into the Cabin   

Occupants of Motorised Wheelchairs must be accompanied and assisted by a capable adult carer, adult guardian or adult companion.

The capable adult carer, or guardian or companion must manually push the occupant of the  Motorised Wheelchair on board the Cabin. 

Once inside the Cabin, the Motorised Wheelchair must be parked and the brake applied and engaged within the designated Wheelchair Parking Zone denoted by floor markings on the south side of the Cabin and remain in that area for the duration of the flight.

4.6 It is recommended that individuals and groups with any wheelchair accessibility requirements always pre-book with The Melbourne Star.

4.7 Guests deaf/Deaf, Hard of Hearing should be accompanied in the Cabin by a capable carer, guardian or companion who has the ability to hear announcements and safety instructions over the In-Cabin Audio and Phone Intercom system.

The capable carer, guardian or companion must have the ability to communicate verbally with The Melbourne Star Management team via the In-Cabin Audio and Phone Intercom system.

5.  CHILDREN

General  

5.1     Children aged 11 years and under must be supervised by a parent, guardian, carer, authorised supervisor or teacher aged 18 years and above. 

Children must always remain under direct control and supervision at all times in The Melbourne Star Cabin and when in any area of the Melbourne Star Premises.

5.2     The parent, guardian, carer and supervisor is responsible for:   

·       the care, conduct, behaviour and wellbeing of those children at all times; 

·       any acts and damage committed by children.

Private Cabin    

5.3 Children under the age of 18 years, in the company of a parent, guardian, carer or authorised supervisor is permitted in a Private Cabin where alcoholic beverages may be available.

Children under the age of 18 years are strictly prohibited from consuming alcohol.

6.   PHOTOGRAPHY AND USE OF EQUIPMENT

By holding a ticket for a flight on The Melbourne Star and by entering any part of the Melbourne Star Premises:

·       you are deemed to have read, understood and accepted all The Melbourne Star Terms and Conditions;

·       you have agreed to comply and be bound by The Melbourne Star Terms and Conditions;

·       must adhere to all photography and filming restrictions requested by The Melbourne Star.

6.1     The Melbourne Star, Melbourne Star Premises, Melbourne Star Piazza and Cabins are under constant video surveillance.

6.2     Unless expressly prohibited by The Melbourne Star Management team, you are permitted to take photographs and recordings provided that these are solely for your personal and private use only and not sold or used for any commercial or public purpose.

You agree, accept and will comply with any demand by The Melbourne Star Management team:

·       to have access to all photographs taken, audio and video footage captured by you whilst at The Melbourne Star and any request that you delete certain photographs and audio video footage if:

  • deemed by The Melbourne Star to be offensive;
  • it infringes the privacy of Guests and Melbourne Star staff;
  • it was taken without the individuals permission;

·       not use mobile electronic equipment such as mobile phones, radios, music players and personal stereo equipment that may cause annoyance to other Guests inside The Melbourne Star Cabin.

·       not use large professional audio, video, photography or cinemograph equipment inside The Melbourne Star Cabin, The Melbourne Premises and on the Melbourne Star Piazza;

·       not use large tripods for cinemograph, audio visual and photographic purposes inside the Cabins.

6.3     The Melbourne Star and authorised third parties carry out photography and video recording at The Melbourne Star Premises and/or on The Melbourne Star Piazza. 

Your image may be captured at any time and may be used by The Melbourne Star in publicity, promotional or advertising material and used for the sale of souvenir photographs, for security or for other purposes.

By holding a ticket for a flight on The Melbourne Star and by entering any part of the Melbourne Star Premises:

·       you agree that The Melbourne Star or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever;

·       you agree that all copyright, trademarks and intellectual property of these materials belongs to The Melbourne Star and authorised third party. 

There will not be any kind of payment, compensation or reward to you. 

7.    ALCOHOL CONSUMPTION AT THE MELBOURNE STAR

Any person, including Guests, affected by or who appears to be affected by alcohol, or drugs Will Not Be Permitted entry to The Melbourne Star, Melbourne Star Premises and Melbourne Star Piazza.

General  

7.1     The Red Line areas at The Melbourne Star are the Café and Cabins.

         No alcoholic beverage is allowed outside the Red Line boundary.

If you do not comply you will be removed from The Melbourne Star by Melbourne Star personnel, security or police officers, without any right to a refund of your ticket. 

This is without prejudice to any claim that The Melbourne Star may have against you or arising out of your actions. 

7.2     Non-alcoholic drinks are permitted only if the drinks are contained in sealable plastic bottles, cans or container.

7.3     Food or alcoholic beverage not purchased from The Melbourne Star café Must Not be taken into a Cabin.       

7.4     Food or alcoholic beverage purchased from The Melbourne Star café prior to your flight is allowed to be consumed in The Melbourne Star Cabin.      

7.5     Eskies, wine coolers or any other container used to hold any type of alcoholic product is Not Allowed in The Melbourne Star Cabin.

Private Cabin    

7.6     Food, alcoholic beverage and catered dining can be pre-arranged by The Melbourne Star only.

7.7     The Melbourne Star will control the quantity of liquor available for purchase for In Cabin consumption and is restricted as follows:

·       Beer     -375 ml. (1.5 equivalent standard drinks);

·       Wine    -150 ml. (1.5 equivalent standard drinks);

·       Pre-mixed spirits   -375 ml. (1.5 equivalent standard drinks);

·       Cider    -375 ml. (1.5 equivalent standard drinks).

No glassware will be supplied to guests from the café for consumption of alcohol in the cabins.

7.8     Children under the age of 18 years, in the company of a parent, guardian, carer or authorised supervisor is permitted in a Private Cabin where alcoholic beverages may be available.

 Children under the age of 18 years are strictly prohibited from consuming alcohol.

Unaccompanied Minors         

7.9    All unaccompanied minors:

·       will not be allocated to a Cabin where alcohol is being served;

·       although allowed to be present in the licensed premises, will not be permitted to purchase alcohol from the café area;

·       will be placed by The Melbourne Star Management team in a Cabin where alcohol is not being consumed.

8.    LIABILITY AND DISCLAIMER

8.1     There are inherent risks in the participation of or on any amusement device or attraction.

 As a passenger on The Melbourne Star, you are accepting those risks which a prudent person is or should be aware and you are required to always exercise good judgement and always act in a responsible manner whilst at The Melbourne Star.

8.2     Except as otherwise prohibited by law, you acknowledge and accept that The Melbourne Star Management and staff are not liable to you:

·       for any loss, damage or injury;

·       for any incidental, direct, indirect, special, consequential or economic loss or damage (including any distress, inconvenience, anxiety, loss of enjoyment arising from the evacuation of The Melbourne Star, The Melbourne Star Premises);

·       for any loss of opportunities, exemplary or punitive damages;

whether to person or to property arising out of the operation of The Melbourne Star or your attendance at The Melbourne Star and whether arising from default, negligence, misconduct or otherwise by The Melbourne Star Management and staff.

You agree to indemnify and hold harmless The Melbourne Star, the Melbourne Star Management and Staff against all claims and liability.

8.3     In the event of a technical fault of The Melbourne Star or in cases of severe and unexpected inclement weather, it is possible that customers may need to remain in their Cabins for an extended length of time until the fault is rectified or the weather improves or, in an extreme case, customers may be required to be evacuated.  

In this event, The Melbourne Star, The Melbourne Star Management and Staff shall not and will not be liable for any direct or indirect loss or damage arising, including, for any distress, inconvenience or anxiety caused during the course of any flight or evacuation. 

9.    DEFINITIONS AND INTERPRETATION

The following words in The Melbourne Star Terms and Conditions have these meanings:

AEST – means Australian Eastern Standard Time.

AEDST – means Australian Eastern Daylight Standard Time.

Alcohol – the intoxicating principle of fermented liquors.

Cabin – means capsule attached to The Melbourne Star.

Café – the Melbourne Star restaurant.

Daily Operational Hours – means the Summer Operating Times (September to April) and the Winter Operating Times (May to August).  Exact timings are advised on the Melbourne Star website – www.melbournestar.com.

Duty Manager – located at Guest Relations and in the key Operations person on duty on the day.

Entry Host – means a Melbourne Star staff member allocating cabins.

Event – means a Melbourne Star managed activity.

Evidence of age document – proof of identity and age, photo identification.

Flight – a ride in the Cabin that takes approximately 30minutes.

General Admission Ticket – means a ticket purchased for a single admission on the Melbourne Star for use during daily operational hours and is not valid for Melbourne Star Special Events.

Guest – You, our valued customer.

Guest Relations – means the Melbourne Star Management and Staff that supervise and manage the Melbourne Star Ticket Office.

Intoxicated – inebriation, to be affected temporarily with loss of control over the physical and mental powers, by means of alcohol liquor.

Legal – permitted by law.

Licensee – one to whom a license is granted, especially to sell alcoholic drinks.

Licensed – authorised to sell alcoholic beverages.

Operator – means Sanoyas Rides Australia Pty. Ltd. the company that manages all the facilities at the Melbourne Star.

Operational Hours – means Daily Operational Hours.

Premises – means The Melbourne Star, the Melbourne Star Building and the Melbourne Star Piazza situated at 101 Waterfront Way, Melbourne Docklands, Victoria, 3008.

Private Cabin – means a cabin on the Melbourne Star hired for the exclusive use of a group of persons.

Staff – means the employees, agents or contractors of the Melbourne Star. 

Sights & Lights Ticket – means a ticket purchased for a dual admission on the Melbourne Star and is not valid for Melbourne Star Special Events. Once your first Sights & Lights flight is redeemed, your second flight must be taken within 30 days, or prior to the ticket expiry date if less than 30 days, of your first flight being redeemed.

Ticket – means a paid document that entitles a Guest to take a ride in a Cabin.

Ticket Office – Located on the ground floor at 101 Waterfront Way, Docklands, Melbourne.

The Melbourne Star Building – means the Premises situated at the Melbourne Star.

The Melbourne Star Management and Staff – means those employees, agents or contractors of the Melbourne Star authorised to act as and identified as, managers at the Melbourne Star.

The Melbourne Star Piazza – means the land area on which the Melbourne Star is situated.

The Melbourne Star Premises – means the Melbourne Star and Melbourne Star Building situated at situated at 101 Waterfront Way, Melbourne Docklands, Victoria, 3008.

The Melbourne Star – means Sanoyas Rides Australia Pty. Ltd. trading as the Melbourne Star Observation Wheel (ABN 84 165 079 390) as the Operator of the Melbourne Star, the Melbourne Star Building and the Melbourne Star Piazza situated at 101 Waterfront Way, Melbourne Docklands, Victoria, 3008.

The Melbourne Star Special Event Packages – means packages developed by the Melbourne Star for events, festivals and ad hoc promotional activity.

The Melbourne Star Ticket Office – means the location from which tickets for a flight on the Melbourne Star can be purchased. 

Melbourne Star Building – means the building situated at 101 Waterfront Way, Melbourne Docklands, Victoria, 3008, incorporating the Melbourne Star.

Melbourne Star Piazza – means the forecourt and surrounding area of the Melbourne Star Building situated at 101 Waterfront Way, Melbourne Docklands, Victoria, 3008.

Minor – someone younger than 18 years of age

Terms and Conditions – means these Terms and Conditions dated 1 December, 2017.

Third Party Provider – means a company authorised by the Melbourne Star to provide certain Events on the Melbourne Star.

User Pay Locker – means lockers located near the Ticket Office that can be hired to store personal items.

You – means the individual ticket holder or purchaser or a person entering the Premises.

Your – means You and Guests.

10.   JURISDICTION

The Melbourne Star Terms and Conditions are governed by and shall be construed in accordance with the laws of the State of Victoria, Australia.

You irrevocably submit to the exclusive jurisdiction of the courts of the State of Victoria, Australia.  To the extent that these Terms and Conditions contravene the laws of the State of Victoria, Australia and are not enforceable (or part or parts thereof), they shall be severable without invalidating the remaining parts thereof.

The Melbourne Star reserves the right to change these the Terms and Conditions at any time without notice.
